Prosecution

The Prosecutor is responsible for prosecuting all violation and misdemeanor level offenses, and all juvenile offenses, initiated by the Londonderry Police Department. The Prosecutor also handles certain felony offenses committed prior to October 1, 2017. 

Defendants representing themselves are entitled to request “discovery” pertaining to their case. “Discovery” includes police reports, witness statements, and other evidence that may be used in the prosecution of the case. If you are the victim of a crime, you have the right to confer with the Prosecutor regarding the case and to have your views taken into account. Victims do not bring charges; the State does. Therefore, victims cannot “drop charges” themselves. If you are a crime victim and you have questions about the case or the process in general, contact the Prosecutor. 

Defendants and/or victims sometimes want the court to make changes to the criminal bail protective order that is commonly issued in certain cases. Only the judge can make those changes. Visit the Derry District Court for assistance in filing the appropriate motion. Additionally, you can find “motion” forms at the court’s website. You must always send the Prosecutor a copy of your motion in addition to filing it with the court.
